Your
signature on this agreement serves as consent to allow
Keep Sake Flowers designers to
create your Keep Sake using their best judgment and discretion
based on your selections. Because Keep Sake creation is
custom work, all sales are final. Design selections are
final upon mailing this order form completed and signed by
you. Once your Keep Sake is completed and delivered, any
desired changes or alterations shall be at your expense
including material, labor and shipping costs.
If
the bride is not available, the flowers may be sent with a
$125 deposit and selections may be made
later.
The
manner which you handle and ship your flowers, as well as the
condition of the flowers themselves, directly affects the
quality of your Keep Sake. Therefore, Keep Sake Flowers.
will not assume liability for any damages to your flowers
prior to their arrival at our facility.
When you
place your order, a non-refundable 85% deposit is required to
begin designing your Keep Sake. Upon completion of your
Keep Sake, you will receive an invoice as notification, your
Keep Sake is ready for shipment. Final payment must be
received before Keep Sake Flowers will ship the completed Keep
Sake. All balances not paid within 30 days of the final
invoice date will be charged (10%) ten percent interest for a
period of (2) two months. After this (2) month period of
time your Keep Sake will become the property of Keep Sake
Flowers to be disposed of at our discretion. All
shipments are F.O.B. seller and are subject to government
regulation.
The
bouquet is being preserved to be sealed in a frame. Every
flower is preserved according to the process which will best
retain its shape and color, therefore, the bouquet must be
taken apart and redesigned to fit the Keep Sake selection.
Please Note: During the preservation process the flowers may
reduce in size and colors may become more subdued or deepen in
color, but always with a pleasing result.
Since your
bouquet or arrangement has probably experienced some wear by
the time it is received by Keep Sake Flowers some flowers
occasionally may require replacement. Added cost
of replacement flowers will be charged to the client after
consultation and approval by the client.
All keep
sake memorabilia to be included in the order must be received
within 30 days after receipt of the bouquet. The order is
considered inactive until all memorabilia (invitations,
garters, etc.) is received and included in our work order
schedule. If the items are not received within 30 days, Keep
Sake Flowers will proceed with the order without the item or
items without notification. If additional items are delivered
that were not agreed to in the original agreement, those items
will not be included in your Keep Sake without your written
permission. Note: If you want to have your order completed by
a certain date, notify Keep Sake Flowers and the feasibility
of the request will be determined on an individual basis.
Normal completion time for your Keep Sake is
approximately 12 to 15
weeks from the date of active scheduling.
Please Note: Your Keep Sake order
is designed for permanent assembly. If upon confirmation of
your order, you decide to make changes not agreed to in your
original order, you will incur expenses of a minimum of
$125.00 (one hundred and twenty five
dollars).
Keep Sake
Flowers will not be held responsible for damages incurred by
the customer or their agent to the completed Keep Sake.
Damages to the Keep Sake such as mishandling, exposure to
extreme temperatures or any other mistreatment will, if
possible, be repaired by Keep Sake Flowers at a mutually
agreed upon cost that includes labor and materials. Keep Sake
Flowers guarantees our quality and workmanship for one
year.
Due to the
fact flowers are very fragile and require special handling
even prior to Keep Sake Flowers acquisition, Keep Sake Flowers
liability is limited to up to 100% refund of deposit.
This agreement will be governed by the laws of Florida and
venue for any dispute will be in Dade County, Florida.
In any dispute the prevailing party will be entitled to
recover fees and costs. |
